you both have a point, the difference is with a building or statue etc, you can have different light, angles etc. Is a picture of a poem any different from a picture of somebody's photograph.
IMO you would need to add something, to the photograph, see some background, a pen etc, not just looking like something that could just as easily have been scanned.
