Why not? As I know birds an go every where they want...specially to find insets for dinner....

Interesting photo, but things right in the middle of a photo, isn't usually the most appealing. Have a look at 'The rule of thirds'

This is a wonderful photo of a bird, but it doesn't really follow the theme
I'm fine with this one, as the author said, 2 birds flying together.
An impressive picture no doubt, but I have to agree with kyri that it doesn't follow the theme. IMHO It hardly looks as if things are ''seen'' from way above
Thanks for the comments. Actually this was taken from the top bridge of a big ship and the bird flew underneath me as I was looking down on it. The water is many meters away as is the bird. I cropped it some to bring the bird closer in. But if I were another bird flying beside this one as many birds were doing at the time, I could easily see myself as a bird. I re read the theme several times and feel that the photograph is on theme. The rule does mention not too far away. All birds do not fly very high nor at night. Many birds remain close to the ground and do not fly higher than the trees out of fear of predators. As always however who ever makes the decision just let me know and I will abide by the moderators choice. No problem from me. It is a fun contest with great photographs.

Moderators? Perish the thought! It's just that the picture gives the impression that the bird or birds is/are almost level with your eyes. Good luck
Now this is a fantastic photograph of a flying bird from the Birdseye View I like how you managed to stop the bird inflight, and that it is extremely well focused. The composition and exposure are great.
