It does say: Give us your best shot from a moving vehicle. Bike, boat, sled, scooter, gondola... whatever. Show proof that the photo was taken from a moving vehicle (eg. post a road, a part of the window, moving water, ...). And an aircraft IS a moving vehicle.

While walking along a trail, I happened to look to my left and there he was. And so close too. I took several photos. After I was done, I went down the trail a bit and was surprised that people never even noticed him. We have to stop and look around. (5 years and 3638 days ago)

Indeed as the bird is already in the air and he is still doing his best to get off the ground(and he never managed to do that, at least not in this picture or place).
