I queried the author and here is his reply, which I accept;
"the photo in question as it was taken
some time ago. I pulled it off my blog for the contest. But I assure you that the
picture was indeed the color that you see. It was a very gloomy day in Canada and
the timing was just right I guess."
It is not black and white, which you can see for yourself if you copy it and put it into photoshop.
Moderator says:
As a mod, I appreciate red flags as they help us. If a member enter a last minute shot, hoping they can pull a fast one, fair enough, but if an entry has been up for several days, I find it most unfair to red flag it within 24 hours of the upload deadline. With the time differences, that makes it unlikely that the author can replace the entry, if it gets pulled.
Some people are not able to vote or comment until the weekends. If a red flag is VALID, it should not be the commenter's problem that the Moderators did not spot the problem previously. I thought the red flags were to assist the moderators, not do their job for them. To use this as an excuse to allow "bad" entries to remain in the competition is not fair to those who DO follow contest guidelines. An incorrect entry should NOT be "given a pass" and allowed to remain simply because the author can no longer replace the entry. If an entry is not valid for a contest, it SHOULD be removed, REGARDLESS WHEN the determination is made. That is what a Moderator's job entails.

Beautiful shot, but B&W aren't on theme for this
