Um, it's empty of people but this is still full of subject matter, the trees for example. IMO, it doesn't really convey emptiness.

ah, but the contest says "If there is some kind of subject you might expect to have something in it (or on it, etc.), but shows the viewer that it's empty, it is on theme." the path could be expected to have people about and they are not there, so it is on theme as the specifications for the contest are written. this contest is not really ambiguous, it is in fact very specific. if someone/something MIGHT be in it and they/it are not, then it is empty. the example of a parking lot would relate very well to a path.
